Durbin to float online sales tax bill (Politico)

Sen. Dick Durbin (D-Ill.) is expected to introduce a bill today that would allow states to require all retailers, including online stores, to collect sales tax owed.

Called the Main Street Fairness Act, the bill would allow states that standardize their tax systems to require retailers to collect sales taxes already owed in the state. Sen. Tim Johnson (D-S.D.) will co-sponsor the bill.

?Without this legislation, local retailers in our communities face a competitive disadvantage because they must collect sales taxes while a growing number of online and catalog retailers do not,? according to information provided by Durbin?s office.

The bill comes at a time when numerous states are battling with online retailers, in particular Amazon, over the issue of requiring those retailers to collect sales taxes. Amazon has fought some state laws by challenging them in court and by severing business partnerships in the state. In California, Amazon is backing a referendum to overturn the law.

The Durbin bill includes a small-business exemption, which will applied by the Governing Board of the Streamline Sales and Use Tax Agreement.

In the House, Reps. John Conyers (D-Mich.) and Peter Welch (D-Vt.) are planning to introduce an identical bill.

Amazon is expected to back the bill. The company has argued that the issue requires a national resolution, which includes tax simplification.

Other supporters include the National Governors Association, the National Conference on State Legislatures, the National Retail Federation, the International Council of Shopping Centers, the Retail Industry Leaders Association, the National Association of Real Estate Investment Trusts and the National Association of College Stores.

Amy Winehouse's "Back to Black" back on Billboard's Top 10 (Reuters)

LOS ANGELES (TheWrap.com) ? Amy Winehouse's music was said to be a big influence on Adele's. And for at least one week, these two British neo-soul sisters get to share the top 10, as Winehouse reentered the Billboard album sales chart at No. 9, while the indomitable Adele moved back up into the top position.

Winehouse's breakthrough "Back to Black" album, released in America in 2007, sold 37,000 copies for the sales period -- virtually all of that between Saturday morning, when her death was announced, and Sunday night, when the SoundScan sales week closed.

Her numbers could be as big or bigger on next week's chart, which will reflect a full week's worth of posthumous interest in the tragic star.

Her far lesser known debut album, "Frank" -- which was only issued in America after "Back to Black" became a smash -- also reentered the chart, at No. 57, after selling 7,600 copies over the weekend.

According to Nielsen SoundScan, more than 95 percent of Winehouse's album sales were digital downloads, which is not surprising, given how most music retailers shy away from carrying catalog nowadays and might have had one CD, at most, in stock.

Things were a little less soulful in the No. 2 position. The franchise that won't die, Kidz Bop, had another strong bow for its latest volume of child-sung songs, which includes heavily bowdlerized versions of provocative hits like Britney Spears' "Till the World Ends" and Lady Gaga's "Born This Way."

"Kidz Bop 20" entered in second place on sales of 69,000, a typical debut for the series.

On the downswing, rock band 3 Doors Down entered two doors down from the top spot they're accustomed to. "Time of My Life," the group's fifth album, sold an initial 60,000 copies -- well under half the 154,000 units their previous effort debuted with three years ago (and an even farther sight away from the six-times-platinum status the outfit mined at their peak).

Other debuting albums included DJ Khaled's "We the Best Forever," a personal best at 53,000 units, bowing at No. 5; rock band 311's "Universal Pulse," in at No. 7 with 46,000; and They Might Be Giants' "Join Us," which joined the Billboard 200 at No. 32.

All of last week's top entries experienced at least a 60 percent decline, and only Blake Shelton's held on well enough to stick around the top 10 at all. The "Voice" coach's "Red River Blue" sold another 47,000 and dropped from the top position to No. 6.

With so little competition, Adele's "21" climbed back to No. 1 by selling 77,000. It was the album's 11th non-consecutive week at the top, meaning it's dominated all other albums in exactly half of the 22 weeks it's been out.

With a total of nearly 2.8 million copies, "21" continues to race far ahead of the pack in year-to-date sales.

The digital singles chart saw scant new action.

The highest new entry was at No. 26, for the Red Hot Chili Peppers' "Adventures of Rain Dance Maggi." The leadoff track for the funk-rockers' upcoming album had first-week sales of 57,000.

A collaboration between Jay-Z and Kanye West, "Otis" -- a teaser from one of the year's most anticipated albums -- did less spectacularly than expected, selling 44,000 to enter at No. 40.

LMFAO's "Party Rock Anthem" continued to dominate among digital songs, with another 209,000 downloads, raising the tune's total to a true-reason-to-party 2.5 million. As expected, Demi Lovato's unusually stark ballad, "Skyscraper," took a steep dive after the initial interest in her comeback, plunging from No. 2 to No. 27.

Study Finds Kids Want More Info About Their Hospital Care (HealthDay)

FRIDAY, July 29 (HealthDay News) -- Excluding children from discussions about their hospital care can make them feel scared and angry, a new study finds.

Parents and medical professionals need to make an effort to consult young patients and include them in decisions, said the researchers from Dublin, Ireland.

The study authors interviewed 55 children and teens, aged 7 to 18, at three hospitals and found that the kids wanted to be included in discussions about their care and to have their views and concerns taken seriously. While some felt included in discussions, most reported difficulties.

Many of the young patients relied on their parents to act as advocates and to explain what was happening, the researchers said.

The investigators also found that the way health professionals communicated and behaved was a major barrier to children being included in discussions about their care. Most of the children said health professionals tended to "do things" to them with very brief or no explanations. Because of rushed consultations, many young patients said they couldn't ask questions or offer information.

In addition, health professionals often directed information at the parents and used language that young patients found hard to understand.

The study is published in the August issue of the Journal of Clinical Nursing.

"Health care organizations need to develop cultures where participation is firmly embedded, not just a desirable add-on. Communicating with children, and including them in decisions about their care, conveys respect, enhances and develops their decision-making capabilities and contributes to psychosocial well-being," study co-author Imelda Coyne, from the School of Nursing and Midwifery at Trinity College Dublin, said in a journal news release.

This means you must know the rents in the area and if the rents will support the last two exit strategies.

A surrogate to this would be to always plan for the long term. In the above scenario, I have both short term and long term financing arranged through private lenders that provide me the flexibility to do whatever the market dictates. The more viable exit strategies available to you tips the odds greatly in your favor that your real estate investment will be highly profitable.

3. Know Your Market! Conduct your market research before investing in real estate to know if your market is a good market to invest in.

Although most beginners tend to start out in their local market, keep in mind that may not be a good place to start. You need to know the answers to some of these basic questions: Who are the major employers in the area and are they stable? What is the population growth trend? What are the local rents and how are they trending? What are the average and median home prices in the area? What economic anchors does the area have?

These are all factors that can have a direct influence on your investment regardless of what niche you may be in.

4. Don?t Get Emotionally Involved. Again I will say, don?t get emotionally involved. Be willing to walk away from any deal that doesn?t meet your criteria.

Although this may sound a little harsh, remember that other people?s pain is your opportunity. You are looking for opportunities where people have to sell rather than just want to sell. Buy your real estate investment in a way that makes sense for you.

Be strategic in your investing criteria and follow your plan. That is, of course, assuming that you have a plan, if you don?t, then put one together. This will help you tremendously from making emotional decisions.

China downplays capability of first aircraft carrier (AFP)

BEIJING (AFP) ? China sought to downplay the capability of its first aircraft carrier Wednesday, saying the vessel would be used for training and "research", amid concerns over the country's military build-up.

China recently confirmed it was revamping an old Soviet ship to be its first carrier, a project that has added to regional worries over the country's fast military expansion and growing assertiveness on territorial issues.

"We are currently re-fitting the body of an old aircraft carrier, and will use it for scientific research, experiments and training," defence ministry spokesman Geng Yansheng told a news briefing.

Asked whether the carrier's addition to China's military arsenal would significantly raise the country's military capability, Geng said only that to "overrate or underrate the carrier's role are both incorrect".

His comments came amid heightened tensions over a number of maritime territorial disputes involving China, notably in the South China Sea, which is believed to be rich in oil and gas and is claimed by several countries.

The issue has heated up recently with run-ins between China and fellow claimants Vietnam and the Philippines, sparking concern among its neighbouring countries and the United States.

In September, a row broke out between Japan and China over the disputed Senkaku Islands, known as the Diaoyu Islands in Chinese, located in the East China Sea.

Chen Bingde, the nation's top military official, provided the first official acknowledgement of the aircraft carrier in a Hong Kong newspaper interview in early June.

Media reports and military analysts, however, have for years said the 300-metre (990-foot) ship was in development.

The ship, once called the Varyag, was originally built for the Soviet navy. Construction was interrupted by the collapse of the Soviet Union in 1991.

China reportedly bought the ship's immense armoured hull -- with no engine, electrics or propeller -- in 1998.

State television on Wednesday broadcast rare footage of the ship, which is based in the northeastern port city of Dalian.

CARACAS (Reuters) ? Venezuela's convalescing President Hugo Chavez laughed off talk of succession on Wednesday and lashed out at speculation his cancer diagnosis was made up to boost his popularity.

"They say I'm putting on a show; it's they who are putting on a macabre show," said Chavez in another TV appearance that has marked a growing public presence since two trips to Cuba for surgery to remove a cancerous tumor and then chemotherapy.

The ever-theatrical Chavez loudly patted his stomach to show he was not wearing a colostomy bag, responding to one theory doing the rounds that his problems are intestinal.

Though no leading opposition figures have publicly suggested Chavez's version of his cancer is untrue, precise medical details have been scarce, and Venezuelans have been endlessly speculating about what condition the president has.

Some in the militant anti-Chavez circles have been muttering that the cancer story is a ploy to boost his prospects ahead of 2012 when he plans to seek re-election in the South American OPEC member he has dominated for 12 years.

"Some of the spokesmen for the squalid ones, the counter-revolution, the right wing, capitalism and the empire ... first they were celebrating because Chavez was dying," he said, laughing. "Now they say I'm making it up."

In a buoyant mood ahead of his 57th birthday on Thursday, Chavez also mocked another topic of national speculation: who might replace him if he becomes incapacitated.

"Hey Adan, you look well-shaven, dressed up, I can see you're preparing for the succession," he said in a TV linkup with his older brother Adan, a governor of Barinas state who has been something of an ideological mentor to the president.

"I'LL WIN IN 2012"

Some have also said that Chavez's daughter, Maria Gabriela, who is an unofficial First Lady, could be a possible successor.

"Don't mess with my daughter," Chavez said. "I am the candidate for the 2012 elections and I'm going to win again."

In a flurry of TV and radio appearances, plus brief attendances or phone-ins to public ceremonies, Chavez has sought in recent days to show he remains firmly in control of government, is recovering and will be fit to seek re-election.

"Fortunately, among all the scenarios, we're seeing the best one, the best recovery scenario," he said, adding that second and third chemotherapy sessions awaited him soon.

"For sure, within a few days you will see Chavez bald," he said in a telephone call to a business meeting in Caracas, referring to a common side effect of the cancer treatment.

"The hair starts falling out for a few months. It's tough."

Though declaring that his operation removed all the malignant cells and no others have been found, Chavez has said he must delegate more, follow a strict medical regime and tone down his famously micromanaging style of leadership.

But the somber and almost fatalistic tone of his first days after announcing the cancer -- when he chided himself for neglecting his health and said he had seen the "abyss" -- seem to be giving way to his old folksy and self-confident style.

"I say to all Venezuelans, however many difficulties there are, we will get through!" he told the business meeting.

'Evil' Australian hacker faces 49 charges (AFP)

SYDNEY (AFP) ? A man who used the online nickname "Evil" has been charged with hacking attacks that police Wednesday alleged could have caused considerable damage to Australia?s national infrastructure.

The 25-year-old unemployed truck driver, who had been unable to find a job in information technology, faces 49 charges after a six-month investigation into his online activities.

They include hacking into the systems of Platform Networks, one of the 13 service providers for the National Broadband Network (NBN), the largest infrastructure project in Australia's history.

Potentially, customers could have lost their services, depending on the security back-up they had in place.

"While Platform Networks had strong cyber security measures in place, even the best security systems are only as strong as the weakest link," said Neil Gaughan, the federal police's High Tech Crime Operations manager.

"It only takes one user with a weak password to put an entire network at risk."

Police allege the man spent up to 20 hours a day on his home computer as he worked on the attack, motivated by ego after failing to secure a job in the IT sector.

"The Australian Federal Police will allege in court that this person acted with an extreme and unusual level of malice and with no regard to the damage caused, indiscriminately targeting both individuals and companies," said Gaughan.

He is due to appear in court Wednesday charged with one count of unauthorised modification of data to cause impairment, and 48 counts of unauthorised access to, or modification of restricted data.

The first charge carries a maximum penalty of 10 years' jail while the second count carries a maximum sentence of two years.

Asian stocks weighed down by US debt concerns (AP)

HONG KONG ? Most Asian stock markets fell Wednesday as the U.S. government edged closer to defaulting after lawmakers in the world's biggest economy failed to make significant progress on raising its borrowing limit.

Oil dropped to near $99 a barrel. The dollar weakened against the yen but strengthened slightly against the euro.

U.S. Republican leaders had promised a vote Wednesday in the House of Representatives on a plan to increase the $14.3 trillion debt limit and avoid America's first-ever default. But the vote was put off until at least Thursday.

Investors are concerned that time is running out to break the deadlock over raising the borrowing limit as the Aug. 2 deadline looms. If a deal is not reached by then, the government won't have enough cash to pay all its bills and could default on its debt.

Currently, about 40 cents of every dollar spent by the U.S. government is borrowed. Lawmakers are divided over how to get the U.S. government accounts into a healthier state in the longer term.

"The stalemate over the U.S. debt ceiling limit will likely weigh on sentiment while the pressure on the U.S. dollar is likely to continue," strategists at Credit Agricole CIB wrote in a research note.

Investors in Asia reacted coolly after news that the lawmakers put off the vote by a day.

Japan's Nikkei 225 stock average fell 0.6 percent to 10,041.01 andSouth Korea's Kospi edged down 0.1 percent to 2,167.22.

Australia's S&P/ASX 200 fell 0.3 percent to 4,560.30 and Hong Kong's Hang Seng Index was nearly unchanged at 22,570.35.

Benchmarks in Singapore and New Zealand also retreated.

China's Shanghai Composite Index rose 0.1 percent to 2,706.15.

In currencies, the dollar weakened slightly to 77.84 yen from 77.88 late Tuesday in New York. The euro slipped to $1.4505 from $1.4518. On Tuesday, the euro rose above $1.45 for the first time since July 5, while the dollar fell below 78 yen for the first time since mid-March.

Benchmark oil for September delivery was down 46 cents to $99.13 a barrel in electronic trading on the New York Mercantile Exchange. Crude lost rose 39 cents to settle at $99.59 on Tuesday.

GENEVA ? The United Nations says it faces a $4.3 billion shortfall in helping the 50 million people worldwide in need of emergency food, shelter and other humanitarian aid.

Valerie Amos, the U.N.'s top humanitarian and emergency relief official, says $7.9 billion is needed this year by the U.N. and hundreds of other aid organizations to help those suffering from disasters, drought and violence in 31 nations.

She says only $3.6 billion has been received so far.

Amos said Wednesday the conflicts in Libya and Ivory Coast, the Horn of Africa and Yemen and South Sudan are creating a need for far more money.

She says it is particularly hard to get donors to pay for aid in West Africa, Zimbabwe, Djibouti and Niger.
